6 Things to Do If You’re at Fault in a Car Accident

A Car accident is more common than many people realize. In 2020, there were 1.59 million car crashes resulting in injuries across the United States, and a further 35,766 crashes that led to a fatality. Two of the main causes of accidents are speeding and drunk driving. Around 31% of crashes are caused by a drunk driver, with 13,384 people killed in 2021.

Being at fault in a car accident is never a good experience but if you are to blame for the collision, it’s likely that you are feeling guilty as well as traumatized. While no one wants to be in this position, it’s important to stay calm and know the right steps to take after an accident you caused. Here are six things, according to a car accident lawyer, that you should do if you’re at fault in a car crash.

Stop the Vehicle and Check for Injuries

The first thing you need to do is stop your vehicle right away, even if the accident seems minor. Make sure everyone involved, including yourself, is uninjured. If there are injuries, call 911 immediately. Provide first aid if you can safely do so while waiting for medical assistance.

Secure the Scene

66% of alcohol-related accidents happen between midnight and 3 AM, so if it’s dark, you need to make sure everyone is out of the road to avoid any further collisions.

To prevent another accident from happening because someone didn’t spot stationary vehicles in the road, turn on your hazard lights, set up road flares or warning signs, and try to get your vehicle out of traffic lanes if possible. This helps prevent more damage or injuries from happening.

Contact the Police

Even if the accident seems relatively minor, you should still contact the police. Many states, including Michigan, Montana, and New Jersey legally require you to report accidents to the police immediately when there is significant damage or injuries. Cooperate fully with any law enforcement that arrives and be honest about what happened.

Exchange Information

Get the contact and insurance information of the other driver(s) involved. You’ll also need to provide them with your name, address, phone number, insurance details, driver’s license number, and vehicle registration. Having all these details is important for insurance claims later. Make sure to get the names and contact information of any passengers or witnesses as well.

Speak with a Car Accident Lawyer

Consult a car accident lawyer before you contact your insurance company. They can ensure you are protected in the event of a claim made against you. You might not be 100% to blame for the accident.

Notify Your Insurance Company

Contact your insurance provider to let them know about the accident, even if you don’t think you’ll need to file a claim. Describe what happened honestly and in detail. Cooperate with their investigation and follow their instructions for getting estimates, taking photos, etc. Accept liability if you’re at fault. Your insurer will advise what to do next.

Being at fault in an accident is no fun, but taking the right steps immediately after can make the process smoother. Staying calm, being honest, and cooperating with law enforcement and your insurer will help you handle the situation properly.
